The electronic visa (hereinafter referred to as “E-Visa”) facility offered through the Sri Lanka Immigration (hereinafter referred to as DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA).

Users/Visa applicants MUST note:

• The acceptance of an online visa application and submission of the application to the DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA is subject to the sole discretion of DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA and mandates given from time to time to IVS GBS.
• The grant, duration, condition/s or refusal of a visa or the time taken for processing a visa application is subject to the sole discretion of DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA.

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE APPLYING, AS VISA FEES AND SERVICE FEES ARE NOT REFUNDABLE UNDER ANY CIRCUMSTANCES.

IVS GBS’s role in processing visa applications is confined to the following:

• Upon receipt of the online application form from the applicant, with the supporting documentation as per the criteria prescribed by DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA (collectively, the 'Documents') and the applicable visa and service fees along with applicable taxes (if any), IVS GBS conducts a review of the supporting documents submitted by the applicant as per the mandates given by the DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA
• Submitting the documents in a JPEG/PNG/PDF format to DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA, on behalf of the applicants via internet. Please note that in case the applicants do not fulfill the eligibility criteria prescribed by DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA, the visa might get delayed or may be rejected. In any such event/s whatsoever IVS GBS shall not be liable for the said delay of visa or for visa rejection and applicant agrees to the same. IVS GBS’s sole obligation in such cases shall only be to communicate the position of the status of the visa to applicant via email.
• Collecting visa fees on behalf of DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA in Sri Lanka and applicable service fees and taxes as applicable.
• Communicating the visa decision status to applicant pursuant to the applications being forwarded to DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA via email and in case of visa being granted sending the electronic approval via email accordingly.

Neither IVS GBS nor DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA shall be liable for any claim whatsoever including but not limited to for outcome of whatever visa result/decision may be by the DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA or for refund of visa, service fees and applicable taxes etc. The visa fees, service fees and applicable taxes once paid are non -refundable in any event whatsoever. The applicant specifically agrees to the same.

While using the facility, users/visa applicants are urged not to engage or avail services of unauthorized persons, entities and touts. Applicants are also advised against divulging any personal and other information such as payment receipts, passport particulars and related details to any third or unknown persons.

The user/visa applicant shall be solely responsible for any such activities mentioned herein and for the resultant consequences that may arise therefrom and shall also be liable for the appropriate prosecutions and liabilities for the same.

Notwithstanding anything to the contrary, the user/visa applicant acknowledges that DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA reserve the right to ask for further documents, information and material to assess an application and take a decision at their own discretion on the basis of such information / further information, material and documents submitted or furnished by the applicant.

The user/visa applicant further acknowledges that the applicant understands that the grant, duration, condition/s or refusal or the time taken to process an application and grant a Sri Lanka Visa are at the sole discretion of DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA and their decision in this regard shall be final. In case of non-forwarding of the application due to incomplete documents or information or any delay in the process of visa application, no correspondence will be entertained from the user/visa applicant by the IVS GBS and IVS GBS shall not be responsible for the same nor shall refund any visa fees, service fees and/or applicable taxes once paid by the user/visa applicant. IVS GBS shall not be liable to any user/visa applicant in any manner whatsoever.

In case of any refund due to the user / applicant if any, which shall be at the sole discretion of IVS GBS or DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA, in such an event the same would be done only via the mode of payment through which the payment was done by the user/visa applicant. The refund would not be allowed to be made on different account other than the account used by the user/applicant while applying for their visa. The refund amount would not include the service charges or any applicable taxes if charged by IVS GBS/ Banks. User/Applicants explicitly agree to accept that these charges would be borne by them and are non-refundable in any circumstances whatsoever. Though the process of refund would be initiated, the actual credit to the applicant’s account will depend on the different payment / billing cycles of the debit / credit card companies / banks world over etc. and may be on many other reasons.

Further, IVS GBS shall not be responsible in any manner whatsoever to any user/visa applicant/s for any Documents lost in transit by accident, theft, natural calamities (acts of God) or any other reason outside the control of, or not arising out of any willful act or default by IVS GBS. IVS GBS does not warrant or guarantee in manner the delivery of the Documents, material or information as a user/visa applicant may require, but will extend and provide services to the extent and to the points as notified and communicated to a user/visa applicant.

The applicant agrees and accepts that IVS GBS neither controls DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA nor does it control or operate the services provided by them. Hence, IVS GBS will not be liable or responsible in any manner whatsoever for any loss or damage of user’s/applicant's documents not caused due to the negligence on the part of IVS GBS.

The use of srilanka.ivsgbsevisa.com ('Site') is at the discretion of IVS GBS and use by anyone may be restricted or terminated by IVS GBS at any time. For efficient and faster processing of the visa applications, IVS GBS has agreed to provide with online platform as a means of communication between DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA and the visa applicant. Also, IVS GBS ensures that the documents are as per the mandates provided by DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA.

In no event and under no circumstances shall IVS GBS and/or their representatives be liable for any direct, indirect, punitive, incidental, special or consequential damages or any other damages of whatsoever kind to anyone. Please read DISCLAIMER OF WARRANTY below.

Applicants should note that, the issuance of a visa or approval of a visa application does not in any way give the applicant an automatic right to enter Sri Lanka. Entry into Sri Lanka is at the sole discretion of the DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA officer at various ports of entry who is a representative of Government of Sri Lanka. In case of denial of visa or denial of entry into Sri Lanka by the Government of Sri Lanka / DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA, IVS GBS shall in no way be liable to the applicant in any manner whatsoever. The visa must be accepted as offered and is non-transferable.

DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA / IVS GBS reserves the right to add, alter or vary these terms and conditions at any time without any notice or liability and all applicants availing this facility shall be bound by the same.

IVS GBS shall not be liable if the visa expires before the applicant enters Sri Lanka. It shall be the sole responsibility of the applicant to plan and ensure his/her journey/travel within the visa period.
By using the domain and sub-domains of the Site, the user agrees to the all the terms and conditions, including those available by hyperlink (the 'Agreement' or 'User Agreement') with IVS GBS and the website/s of its affiliate/s, joint venture partner/s, agencies, subsidiaries and clients. Please note that you are dealing with IVS GBS, its affiliate/s, joint venture partner/s, agencies, subsidiaries and clients and agree to be bound by the terms and conditions herein. The off line partners, franchisees, of IVS GBS shall not be liable for any issues or disputes arising out of the use of this website by the user / applicant or delay or non-forwarding of the application or rejection of visa pursuant to the online application. Before you proceed to use the site, you must read and accept all terms and conditions in, and linked to, the Terms and Conditions, Disclaimer Policy and the Privacy Policy to be able to proceed further.

Do not use the Site if you cannot or are barred from entering into legally binding contracts or if you are under the age of 18 or are temporarily or indefinitely suspended or prohibited from or accessing or using this or the linked sites as may be applicable.

By accepting the Terms and Conditions, you agree that your use of IVS GBS website and websites related and linked to IVS GBS Website will be governed by all the terms and conditions, Disclaimer Policy and Privacy Policies posted on that website/s with such changes and modifications as may be made from time to time.

By choosing to apply for your Sri Lanka E-visa on using the IVS GBS online application, user/ visa applicant acknowledges that they are allowing IVS GBS to extract data from the mandatory documents using a third party solution, to be used to fill the online visa application form. IVS GBS will only use the data extraction for the sole purpose of filling the online application form (as accurately as possible), in order to make it easier for user / visa applicant to complete their online application. User / visa applicant acknowledges that they are responsible for checking their complete application form to ensure the information is correct, before submitting the application. IVS GBS is not liable if your application form has incorrect information.

IVS GBS reserves the right to charge the following service fee in addition to the fee charged by the government of Sri Lanka:-

• IVS GBS Service fee USD 18.5 (Exclusive of Tax)

While accessing or using srilanka.ivsgbsevisa.com (the 'Site'), you agree that you shall not:

• Post any content or items in an inappropriate category or areas on the Site nor post any material in whatsoever form, on the Site for any purpose other than the normal purpose for which the Site is intended;
• Violate any laws, rules, regulations, third party rights, or policies of IVS GBS. You shall not hide or spoof your IP address or intentionally bounce your communications through any intermediate computers. You shall also not alter the logs upon gaining access;
• Interfere with the technological operations of the Site or attempt or manipulate the content or material on Site or of any other user or users;
• Post false, inaccurate, misleading, defamatory, or libelous content including personal information;
• Use any robot, spider, search engine, scraper or other means whether manual, automated, mechanical, electrical or electronics either existing or that may be invented or discovered to access the Site and/or to do any of the acts mentioned above for any purpose other than the normal purpose for which the Site is intended;

Additionally, you agree not to:

• Take any action that imposes or may impose (in our sole discretion) an unreasonable or disproportionately large load on IVS GBS’s IT infrastructure;
• Interfere or attempt to interfere with the proper working of the Site; or any activities conducted on the Site;
• Bypass IVS GBS's robot exclusion headers or other measures IVS GBS may use to prevent or restrict access to the Site.
• Do or take any action that may undermine the feedback or ratings systems, such as displaying, importing or exporting feedback information of the Site or for using it for purposes unrelated to IVS GBS;
• Access or attempt to gain root access, use any manual, mechanical, electrical or electronic means, computer programs, exploits, hacker tools, or scripts, software or hardware tools, search engines either existing or that may be invented either directly, indirectly or through any contrivance to change, modify, post, violate, misuse, abuse, erase, hack, distort, slow down, configure any system, website, to work for them, or to cause denial of services to other users or on other computers or down the Site or its user features;
• Send, post, plant or distribute viruses or any other technologies that may harm IVS GBS, or the interests or property of users.
• Copy, modify, or distribute content from the Site and/or IVS GBS 's copyrights and trademarks; or
• Harvest or otherwise collect information about other users, their details, or any information relating to any other user’s passport details, email addresses, etc. or harvest email IDs belonging to IVS GBS that are mentioned on the Site and use them for sending SPAM mails to others.

In case of any unlawful, illegal or prohibited use, you shall be liable for action under applicable laws of the country including among others and as amended from time to time and shall also be liable for damages.

Without limiting other remedies, IVS GBS at the advice or under the directions of DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA or its clients limit, suspend, terminate temporarily or permanently, disable or prevent a user account or restrict or deny a user from making use of its service, prohibit access to its website/s, remove hosted content, and take technical and legal steps to keep user/s off the Site if IVS GBS thinks that the user is or is attempting to resort to any kind of abnormal usage or abuse, creating problems or possible legal liabilities, or is not acting consistently with the normal usage.

IVS GBS has taken necessary steps to implement and maintain security practices and procedures to protect User Information from unauthorized access, damage, use, modification, disclosure or impairment. IVS GBS has in place suitable protection mechanism and guidelines for usage, retention and protection of User Information against unauthorized access, disclosure or abuse. However, IVS GBS shall not be liable in any manner for any events that occur in spite of such steps, security practices, procedures, protection mechanisms and guidelines.

While IVS GBS makes and strives to provide secure and continuous connectivity and internet access, IVS GBS and DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA shall not be responsible or liable to a user for any loss or consequential damage, including among other things, any loss of data obtained, Documents, time, or other information furnished or entered on the Site or the application forms which may, among other things, have occurred as a result of any events or acts leading to interruptions such as internet connectivity, transmission of signals, server breakdown, systems crashing, hacking, servicing and any other events or acts beyond the control of such parties.

User/visa applicant agrees not to hold IVS GBS responsible in any manner whatsoever for other user actions or inactions, including but not limited to acts or things as a result of which there may be loss of connectivity, loss of data and/or loss of Documents or data furnished.

Further, while secure and continuous access to the website is sought to be provided, IVS GBS does not guarantee continuous or secure access to operation of the Site, as the same may be interfered by numerous factors outside the control of IVS GBS. Accordingly, to the extent legally permitted, IVS GBS excludes all implied warranties, terms and conditions. IVS GBS is not liable for any loss of money, time, goodwill, or reputation, or any special, indirect, or consequential loss or damages arising in any manner out of the user’s use of the Site.

The user agrees to indemnify and hold IVS GBS and their officers, directors, agents, subsidiaries, clients, joint venture partners, associates, representatives and employees, harmless from any kind of claim/s, expense/s, loss/es, damages or demand/s, including but not limited to reasonable attorney’s fees, incurred or sustained by IVS GBS and / or their officers, directors, agents, subsidiaries, clients, joint venture partners and employees arising out of the breach of these terms and conditions by the user and / or any act of omission or commission attributable to user / applicant (or) violation by the user / applicant of any law of any country or the rights of a third party.

Except as explicitly stated otherwise, all notices shall be served on IVS GBS at: Unit 12734 - 001, Building A2, Dubai Silicon Oasis, DDP, Dubai, UAE and to the User/Applicant at the email address : info.evgq@vfshelpline.com and/or address provided to IVS GBS during the online registration process. IVS GBS may issue any notice to the User/Applicant by email or to the address provided by them during the online registration process for visa submission. However, IVS GBS shall not be liable in any manner whatsoever for any non receipt of the Notice if the address provided by User/Applicant during the online registration process is not correct, which User/Applicant agrees to.

A notice given to the User/ Applicant as stated above; must deemed to be received:

1. if delivered at the recipient’s address during normal business hours, on the date of delivery;
2. if sent by prepaid international registered post, seven (7) days after the date of posting;
3. if sent by an express courier with a reliable system for tracking delivery, on the date of delivery to the recipient; and
4. if sent by electronic mail during normal business hours, and provided that a confirmation copy is sent by the Party giving notice, upon receipt of the electronic mail sent, as appropriate, or if outside the normal business hours of the recipient, then at the beginning of the recipient’s next working day.

This Agreement shall be governed in all respects by the laws of UAE, The user agrees that any claim or dispute he/she may have against IVS GBS including but not limited to those that may arise from the use of the Site or services provided by IVS GBS must be resolved by a court of competent jurisdiction located in Dubai to the exclusion of all other courts.

IVS GBS is located at Unit 12734 - 001, Building A2, Dubai Silicon Oasis, DDP, Dubai, UAE. Services are offered by IVS GBS to users residing within and outside nationalities as mentioned above, subject to the user’s acceptance of the jurisdictional terms and other terms and conditions, Disclaimer Policy & Privacy Policy.

If any provision of this Agreement is held to be invalid or unenforceable such provision shall be severed and the remaining provisions shall be valid and enforced. In its sole discretion, IVS GBS may assign this Agreement to any of its affiliates, associates, third parties, subsidiaries and its group companies or whomsoever without reference to the user/visa applicant.

Headings are for reference purposes only and do not limit the scope or extent of such section. IVS GBS’s failure to act with respect to a breach by a user / applicant or others does not imply that IVS GBS waives its rights in any manner to act with respect to any breach, subsequent or similar breaches. IVS GBS reserves the right to take action as it may decide, or as it may be advised /or directed.

DEPARTMENT OF IMMIGRATION AND EMMIGRATION SRI LANKA may at any time amend this Agreement and IVS GBS shall post the amended terms on the Site. Except as stated elsewhere, all amended terms shall automatically be effective as at the time of accessing the Site and using the services. This Agreement may not be otherwise amended except in writing signed by both IVS GBS and the user / applicant. This Agreement sets forth the entire understanding and agreement between the user / applicant with IVS GBS with respect to the subject matter hereof.
